LOSING OUR FREEDOM

On 31 December 2011, President Barrack Obama signed the National Defense Authorization Act Fiscal Year 2012 (NDAA). This 500 plus page Act contains budgeting, draw downs and equipment allocations for the military. What most people don’t know is it also contains Subtitle D Section 1021 and 1022. These two sections have single handedly destroyed some of your basic freedoms. In sections 1021 it reaffirms the Authorization Use of Military Force (AUMF). Section 1022 details the disposition for detention. In section 1022 paragraph b (1) it states that military detention does not extend to U.S. citizens, but in paragraph (a) 4 the President has the right to waive requirements if he feels that it is in the interest of national security.
These two sections give the President or subordinates within the Department of Defense the authority to use military force (includes assassination), indefinite military detention, military tribunals, detain and move to foreign countries, this includes all American Citizens and legal residents. If they think, believe or suspect that you MAY be supporting terrorism you are subject to this section. What is terrorism? It is a violent or threatening act to obtain political or religious demands. Some people like the Southern Poverty Law Center would say it is a patriot group or right-wing fundamentalists (also known as Christians). It could even be our returning veterans according to the Secretary of Homeland Security Janet Napolitano.
The NDAA contains provisions that are destructive to the US Constitution and The Bill of Rights. I will now provide references to which this Act violates. The first violation to the U.S. Constitution is Article I, Section 9 [Habeas Suspension Clause] the privilege of the writ of habeas corpus shall not suspended, unless when in Case of Rebellion or Invasion the public safety may require it. This means that NO ONE can arrest (detain) you without a proper warrant and the arresting officer must also show the courts why the prisoner is being held. Which leads to the next constitutional violation, the 4th Amendment from our Bill of Rights which states; The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall no be violate, no warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. The next violation to the U.S. Constitution is Article III, Section 2, Clause 2 [Trail by jury of all crimes expect impeachment] The trail of all crimes, except in cases of Impeachment; shall be by jury; and such trial shall be held in the state where said crime shall have been committed; but when not committed within any state, the trail shall be at such place or places as the congress may by law have directed.This states that if you are accused of a crime you must receive a trial by an impartial jury of your peers. Only impeachment is not tried by jury, which leads to the violation of the 6th Amendment of our Bill of Rights [Right to a speedy and public trial] this say’s nothing of a military tribunal, which is not public or impartial. Also it violates the 5th Amendment of the Bill of Rights [Right to grand jury indictment and due process]. This Act infringes on the entirety of the Constitution and Bill of Right, making We the People insecure in the exercise of any Rights or Powers.
In section 1021 and 1022, it grants the President the authority he would have over a foreign enemy on a “battlefield” for use against the American people. This act is unconstitutional and a violation of the federal government’s duty of allegiance to protect the U.S. citizens anywhere in the world.
The above noted injures, violations and usurpations are same we fought against for our freedom from Great Britain, as stated in the Declaration of Independence. Here is a quote from that declaration, “That whenever any form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new government,”
We The People need to band together and let our local sheriff, state and national representatives know that we will not stand for such tyranny and disregard to the freedoms which we as a nation have fought and died for. Starting today email, call, write a letter to your state congressman, senator and governor and let them know they need to repeal this traitorous act by supporting House Resolution 3785.
